Undercover Undercoaters
Terms and Conditions of Service
Effective Date: January 1, 2025

These Terms and Conditions govern all services provided under the Undercover Undercoaters brand by independently owned and operated Undercover Undercoaters franchise locations. By booking, authorizing, or receiving services, you agree to these Terms and Conditions.

Independent Ownership and Liability
Each Undercover Undercoaters location is independently owned and operated. By scheduling an appointment, you agree to do business solely with your local Undercover Undercoaters franchise. Undercover Undercoaters is a franchisor and does not perform services. The franchisor has no responsibility or liability for workmanship, scheduling, pricing, service outcomes, or disputes arising from the operations of any independently owned and operated location.

Service Area and Access
Pricing is based on your vehicle being located within the designated service area of the servicing Undercover Undercoaters franchise. Services performed outside this area may incur additional fees.
By booking services, you confirm that Undercover Undercoaters has permission to access and perform work at the scheduled location, whether on your property or a third-party location, including commercial properties and parking facilities. You are responsible for ensuring compliance with all applicable laws, regulations, and property rules. If access is denied, restricted, unsafe, or results in fines, towing, or other penalties due to lack of authorization, you remain responsible for the full cost of the scheduled service and any related expenses incurred.

Vehicle Accessibility and Condition
You must provide safe, unobstructed access to your vehicle with sufficient space for technicians to work safely. If access issues cause delays or require special arrangements, additional charges may apply. Undercover Undercoaters reserves the right to reschedule or cancel service if access issues cannot be reasonably resolved.
Your vehicle must be in safe working order and suitable for undercoating services. Undercover Undercoaters is not responsible for issues arising from pre-existing mechanical problems, defects, rust, corrosion, or damage. You are responsible for disclosing any known mechanical issues, defects, or safety concerns prior to service.

Personal Items
Undercover Undercoaters is not responsible for personal items left inside or on your vehicle. Customers are responsible for removing all valuables prior to service.

Marketing Use and Marketing

During service, the servicing franchise may take photographs or videos of the vehicle, property, or work performed for documentation, quality control, training, and marketing purposes. Any such images will not intentionally include people or personally identifying information. By booking or receiving services, you grant permission for the use of these images in marketing materials, including websites, social media, and advertising, unless you notify the servicing location in writing prior to service that you do not consent to such use.

Estimates, Booking, and Payment
Pricing is based on information provided by the customer and visual inspection where applicable. Final pricing may change if vehicle condition differs from what was disclosed or reasonably observable. Payment is due at the time of service unless otherwise agreed in writing. Services may be confirmed verbally, by email, or by text message. If a valid payment method is not on file, Undercover Undercoaters reserves the right to cancel or reschedule the appointment.

Cancellations
Cancellations or rescheduling require at least two business days' notice. Late cancellations or no-shows may result in charges of up to fifty percent of the scheduled service price.

Appearance, Results, and Variability
Undercoating services are protective in nature. Results may vary based on vehicle age, prior treatments, existing rust or corrosion, materials used, and environmental exposure. No specific outcome, level of protection, or lifespan is guaranteed.

Care and Post-Service Considerations
Customers agree to follow any reasonable post-service instructions provided. Undercover Undercoaters is not responsible for damage or performance issues resulting from misuse, alterations, or failure to follow post-service guidance.

Warranties
Any manufacturer or workmanship warranties are provided by the servicing franchise or product manufacturer according to their written terms. Warranties generally exclude damage caused by misuse, neglect, impact, abrasion, environmental exposure, prior rust or corrosion, or pre-existing vehicle conditions. Warranty claims must be directed to the franchise that performed the service.

Limitation of Liability
To the maximum extent permitted by law, total liability for any claim arising from Undercover Undercoaters services is limited to three times the cost of the service giving rise to the claim, capped at five thousand dollars per visit. Undercover Undercoaters is not liable for indirect, incidental, special, or consequential damages, including loss of use or diminished value.

Insurance and Responsibility
Customers agree that their own insurance coverage will be primary for any covered loss related to Undercover Undercoaters services. Any insurance maintained by Undercover Undercoaters or its franchisees is secondary and non-contributory.

Hold Harmless and Responsibility
To the extent permitted by law, customers agree to be responsible for claims, losses, or damages arising out of the services provided, including matters related to access conditions, disclosed or undisclosed vehicle conditions, customer-approved services or materials, or failure to follow post-service instructions. This does not apply to losses caused by gross negligence or willful misconduct of the servicing franchise.

Waiver of Subrogation
To the extent permitted by law, customers agree that their insurer will not seek recovery from the servicing Undercover Undercoaters franchise or the franchisor for losses or damages covered by insurance.

Dispute Resolution and Governing Law
Service-related concerns must be reported to the servicing franchise within forty-eight hours of service completion. These Terms and Conditions are governed by the laws of the Commonwealth of Massachusetts. Customers waive participation in class or representative actions.

Right to Refuse Service
Undercover Undercoaters reserves the right to refuse or discontinue service if conditions are unsafe, inaccessible, illegal, or inappropriate.

Entire Agreement and Modifications
These Terms and Conditions constitute the entire agreement between the customer and Undercover Undercoaters with respect to the services provided. Terms may be updated from time to time and will be effective when posted on the website. Continued use of services constitutes acceptance of any revisions.

By scheduling an appointment or receiving services, you acknowledge that you have read, understand, and agree to these Terms and Conditions.
